TERMS OF SERVICE

OVERVIEW
Welcome to Kanz & Muhul USA, operated by K&M Intl. LLC, a Single Member LLC registered in the State of California ("we," "us," or "our"). Our principal place of business is located at 2707 Colin Ct, San Jose, California 95148-2575, USA. You may reach us at +1 800-742-5877 or shiban@kanzspices.com.
These Terms of Service ("Terms") govern your access to and use of our Shopify-powered online store at www.kanzspices.com (the "Services"), including all products, content, features, and tools available through it.
BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES. These Terms include a binding arbitration clause and class action waiver in Section 26 — please read that section carefully as it affects your legal rights.
SECTION 1 — ACCESS AND ACCOUNT
By using our Services, you represent that you are at least 18 years of age, or the age of majority in your state of residence, and are fully able to enter into and comply with these Terms. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian.
You may be required to provide your name, email address, billing and shipping address, and payment details to make purchases. You represent and warrant that all information you provide is accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not transfer, sell, or assign your account to any other person.
We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including if we believe these Terms are being violated.
SECTION 2 — OUR PRODUCTS
K&M Intl. LLC sells premium Kashmiri food products including spices, saffron, dry fruits, teas, honey, and related consumables (collectively, "Products"). We have made every effort to accurately represent our Products through descriptions and images. However, colors and appearance may vary depending on your device display settings.
All Products are intended for personal or household culinary use only. Our Products are food items and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Our Products may contain or come into contact with tree nuts (including walnuts and almonds), sesame, and other common allergens. Customers with known food allergies or sensitivities should carefully review product labels and consult a medical professional before consuming any product if in doubt.
Product descriptions, availability, and pricing are subject to change without notice. We reserve the right to discontinue any Product at any time and may limit purchase quantities per person, household, or order at our discretion.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. K&M Intl. LLC reserves the right to accept or decline any order for any reason at its sole discretion. Your order is not accepted until we confirm acceptance and process your payment. An order confirmation email acknowledges receipt of your order but does not constitute final acceptance — acceptance occurs upon shipment.
Please review your order carefully before submitting. Once an order is accepted and processing has begun, we may be unable to accommodate cancellation requests. If we decline, modify, or cancel an order, we will notify you using the contact information provided at checkout.
You represent and warrant that your purchases are solely for personal or household use and not for commercial resale, redistribution, or export, unless you have a separate wholesale or bulk agreement with us.
Your purchases are subject to return or exchange solely in accordance with our Refund and Returns Policy [LINK].
SECTION 4 — PRICES AND BILLING
All prices are listed in US Dollars (USD) and are subject to change without notice. The price charged for a Product will be the price displayed at the time the order is placed, as confirmed in your order confirmation email. Displayed prices do not include applicable sales tax, shipping, handling, or any other charges, which will be calculated and shown at checkout.
California Sales Tax: As a business headquartered in California, we are required to collect applicable California state and local sales tax on orders shipped to California addresses, in accordance with the California Revenue and Taxation Code. Sales tax may also be collected for orders shipped to other states where we have tax nexus, as required by applicable law.
You agree to provide accurate and complete payment information. You represent and warrant that: (i) the payment information you provide is true and accurate; (ii) you are authorized to use the payment method provided; (iii) charges will be honored by your financial institution; and (iv) you will pay all charges including applicable taxes and shipping fees.
If a pricing error is discovered after your order is placed, we will notify you and give you the option to proceed at the correct price or cancel the order for a full refund.
SECTION 5 — SHIPPING AND DELIVERY
We currently ship within the contiguous United States. Shipping timelines provided at checkout are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, weather events, natural disasters, or any circumstances outside our reasonable control.
Title and risk of loss for Products pass to you upon our delivery of the Products to the carrier. Once a shipment is handed to the carrier, we are not responsible for lost, stolen, or damaged packages; however, we will make reasonable efforts to assist you in filing a carrier claim.
If a package is returned to us due to an incorrect address provided by you, refusal of delivery, or failure to retrieve the package, we reserve the right to charge a re-shipping fee or deduct original shipping costs from any applicable refund.
We do not currently offer international shipping through this Store. Orders with international delivery addresses will not be fulfilled.
SECTION 6 — FOOD PRODUCT DISCLAIMER
Our Products are natural food items intended for culinary use. The following disclosures apply to all food products sold through our Store:
(a) Allergen Notice: Our Products may contain or be manufactured in facilities that process tree nuts (including walnuts and almonds), sesame, and other potential allergens. Customers with food allergies must carefully review all product labeling prior to purchase and consumption.
(b) FDA Disclaimer: Statements made about our Products on this Store have not been evaluated by the US Food and Drug Administration (FDA). Our Products are not intended to diagnose, treat, cure, or prevent any disease or health condition.
(c) Natural Variation: As many of our Products are naturally sourced farm items, color, texture, aroma, and appearance may vary between batches. Such variations are inherent to natural products and do not constitute a defect or grounds for return.
(d) Storage and Handling: Customers are responsible for proper storage and handling of Products after delivery. We are not responsible for spoilage or degradation caused by improper storage after delivery.
(e) Expiry Dates: Best-by or expiry dates are printed on product packaging. Customers should check packaging upon receipt and consume Products within the indicated period.
SECTION 7 — INTELLECTUAL PROPERTY
All content available through our Services, including trademarks, brand names, logos, text, product descriptions, images, graphics, audio, and video, and the selection and arrangement thereof (collectively, "Content"), is the property of K&M Intl. LLC, its affiliates, or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, transmit, or commercially exploit any Content without our prior written consent.
The names "Kanz & Muhul," "K&M," "Matamaal," and related logos are trademarks of K&M Intl. LLC or its affiliates. You may not use these marks without our prior written permission.
SECTION 8 — THIRD-PARTY LINKS AND TOOLS
Our Services may contain links to third-party websites or services, including payment processors, shipping carriers, and analytics providers. We are not responsible for the content, privacy practices, or accuracy of any third-party websites. Accessing such sites is at your own risk and you should review their terms and privacy policies independently.
We may provide access to optional third-party tools and integrations. Such tools are provided "as is" and "as available" without warranty. We have no liability arising from your use of third-party tools offered through or in connection with the Services.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
Our Store is powered by Shopify Inc. All sales made through our Store are made directly with K&M Intl. LLC. Shopify is not a party to your transaction and is not responsible for any products, services, or transactions made through our Store. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or relating to your purchases and transactions with K&M Intl. LLC.
SECTION 10 — PRIVACY AND DATA COLLECTION

SECTION 11 — FEEDBACK AND REVIEWS
If you submit any feedback, reviews, suggestions, or other content ("Feedback"), you grant K&M Intl. LLC a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including promotional and commercial use.
You represent and warrant that: (i) you own or have all rights necessary to submit the Feedback; (ii) the Feedback does not violate any third-party rights; (iii) you have disclosed any material connections, compensation, or incentives related to your submission as required by FTC guidelines; and (iv) the Feedback is truthful and not misleading.
We reserve the right to monitor, edit, or remove Feedback that we determine, in our sole discretion, to be unlawful, misleading, defamatory, or in violation of these Terms.
SECTION 12 — ERRORS, INACCURACIES, AND OMISSIONS
Occasionally there may be typographical errors, inaccuracies, or omissions on our Store relating to product descriptions, pricing, promotions, availability, or shipping times. We reserve the right to correct any such errors and to update or cancel orders affected by inaccurate information at any time without prior notice, including after an order has been submitted.
SECTION 13 — PROHIBITED USES
You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:
(a) For any unlawful purpose or in violation of any applicable federal, state, or local law or regulation;
(b) To transmit unsolicited commercial communications (spam) or conduct phishing, pharming, or other deceptive practices;
(c) To infringe upon or violate the intellectual property rights of K&M Intl. LLC or any third party;
(d) To harass, abuse, defame, intimidate, or harm any person;
(e) To impersonate any person or entity or misrepresent your affiliation with any person or entity;
(f) To collect personal information of others without authorization;
(g) To upload or transmit viruses, malware, or other harmful code;
(h) To use automated tools including bots, scrapers, or crawlers to access the Services without our prior written consent;
(i) To reproduce, resell, or commercially exploit any part of the Services without our prior written authorization.
Violation of these prohibitions may result in immediate termination of your access to the Services and may expose you to civil or criminal liability.
SECTION 14 — AUTOMATED AGENTS
If you use, enable, or deploy any automated software, bot, or AI agent ("Agent") to access or interact with the Services:
(a) The Agent must identify itself in all HTTP/HTTPS requests using the format: "Agent/[agent name]" in the user-agent string;
(b) The Agent must not mimic human behavior, circumvent CAPTCHAs, or conceal that interactions are automated;
(c) The Agent must respond truthfully to any prompt seeking to determine if interactions originate from a human or automated system;
(d) We may limit or block Agent access to the Services at any time using technical or other means.
Any Agent access that violates these requirements is unauthorized and constitutes a breach of these Terms.
SECTION 15 — TERMINATION
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason including breach of these Terms. Upon termination, your right to use the Services immediately ceases. You remain liable for all amounts due up to and including the date of termination.
The following sections survive termination: Intellectual Property, Food Product Disclaimer, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Arbitration and Dispute Resolution, Governing Law, and any provisions that by their nature should survive.
SECTION 16 — DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; OR (C) ERRORS IN THE SERVICES WILL BE CORRECTED.
SOME STATES, INCLUDING CALIFORNIA, DO NOT ALLOW CERTAIN DISCLAIMERS OF IMPLIED WARRANTIES. TO THE EXTENT SUCH LAWS APPLY, SOME OR ALL OF THE ABOVE DISCLAIMERS MAY NOT APPLY TO YOU.
SECTION 17 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL K&M INTL. LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED US DOLLARS ($100).
California Residents: You waive California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
SECTION 18 — INDEMNIFICATION
You agree to defend, indemnify, and hold harmless K&M Intl. LLC, Shopify, and our respective affiliates, members, officers, directors, employees, agents, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (i) your breach of these Terms; (ii) your violation of any law or the rights of a third party; (iii) your use of the Services; or (iv) any Feedback you submit.
We reserve the right to assume exclusive control of the defense of any matter subject to indemnification by you, at your expense. You agree to cooperate with us in the defense of any such claim.
SECTION 19 — SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
SECTION 20 — WAIVER; ENTIRE AGREEMENT
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies posted on the Store, constitute the entire agreement between you and K&M Intl. LLC with respect to the Services, and supersede all prior and contemporaneous agreements, communications, and proposals, whether oral or written.
SECTION 21 — ASSIGNMENT
You may not assign, delegate, or transfer these Terms or any of your rights hereunder without our prior written consent. Any attempted assignment in violation of this section is null and void. We may freely assign these Terms and our rights and obligations without restriction.
SECTION 22 — GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Subject to the Arbitration section below, you and K&M Intl. LLC consent to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California for the resolution of any disputes not subject to arbitration.
SECTION 23 — HEADINGS
Section headings are included for convenience only and do not limit or affect the interpretation of these Terms.
SECTION 24 — CHANGES TO TERMS
We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where required by law, notify you by email or prominent notice on the Store. Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms.
SECTION 25 — CALIFORNIA-SPECIFIC DISCLOSURES
Consumer Rights Notice (Civil Code §1789.3): The Services are provided by K&M Intl. LLC, 2707 Colin Ct, San Jose, CA 95148-2575, +1 800-742-5877. If you have a complaint, you may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
Do Not Track: We do not currently alter our data collection practices in response to Do Not Track signals from browsers. Please see our Privacy Policy for full details on our data practices.
Shine the Light (Civil Code §1798.83): California residents may request information once per year about any personal information we have disclosed to third parties for direct marketing purposes. To make such a request, contact us at shiban@kanzspices.com.
SECTION 26 — ARBITRATION AND DISPUTE RESOLUTION
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Agreement to Arbitrate: Except for claims that qualify for small claims court, and claims for injunctive or equitable relief to protect intellectual property rights, you and K&M Intl. LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Services, or any Products purchased shall be resolved exclusively through binding individual arbitration, and not in a court of law.
Class Action Waiver: YOU AND K&M INTL. LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Arbitration Rules: Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at www.adr.org. The arbitration shall take place in Santa Clara County, California, or at a mutually agreed location. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Opt-Out Right: You may opt out of this arbitration agreement by sending written notice to shiban@kanzspices.com within 30 days of first accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in state or federal court in Santa Clara County, California.
